        SUBJECT: Legal Review of Collateral Investigation Into Destruction of
        MIIP Tank


        1. This responds to your request for legal review of the enclosed
        collateral investigation into the destruction of an MIIP Tank on 5 Dec
        90, assigned to Co A, 3rd Bn, 69th AR. The report of investigation
        (ROI) has been reviewed for compliance with pertinent regulatory
        authority and legal sufficiency. The findings are supported by the
        evidence and the recommendations are supported by the findings.

        2. The investigation is administratively complete; however, the
        following comments are provided to document certain additional facts
        pertinent to the investigation:














        3. Recommend that the CG approve the ROI by completing DA Form 1574,
        Section VIII (cross out all words except "investigating officer" and
        "approved") and that one copy of the investigation be forwarded to Cdr,
        FORSCOM, ATTN: FCJI-SO, Ft McPherson, GA 30330-6000. A form of action
        to accomplish this is enclosed.

        4. This legal review should be enclosed to the approved ROI and to all
        copies of the report.
