DESERT SKIELD/STORM LESSONS LEARNED REPORT #Y
POC: [(b)(2)]
TITLE: Pregnancy Policy
OBSERVATION: The policy for duty performance for pregnant
members is not consistent between AFR 28-5 and AFR 35-41,
Vol II.
DISCUSSION: AFR 28-5, USAF Mobilization Planning, pare
10-7 states, "Pregnant members will be deferred from
mobilization immediately upon medical confirmation and will
be given an adjusted AD reporting date that is 6 weeks
after expected delivery". AFR 35-41, Vol II, Reserve
Personnel Policies and Procedures-Reserve Training, pare
1-3, states, "... A pregnant member must not be scheduled
to perform active duty ... past the 34th week of pregnancy.
A member will not be returned to duty earlier than 4 weeks
after delivery." This guidance is not consistent.
LESSONS LEARNED: Inconsistent guidance causes confusion
and is not in the best interest of the Air Force or the
member. Guidance for delay and exemption must be
consistent with guidance for Reserve participation.
RECOMMENDED ACTION: Change AFR 35-41, Vol II, pare 1-3, to
read, "... a member will not be returned to duty earlier
than 6 weeks after delivery". Also change AFR 28-5 to
include a statement about pregnant members being eligible
for mobilization up to the 34th week of pregnancy. This
will bring these regulations in line and the guidance will
be consistent for delay and exemption as well as Reserve
participation.
