          a. ISSUE: The Army failed to notify owners of rented/leased
          equipment when the equipment was damaged or missing. Typically
          there were no provisions for ceasing rental/lease payments when
          equipment was damaged or accountability was lost and the issue
          changed to one of paying for damaged/lost equipment and not
          continued rental/lease payments.
          b. DISCUSSION: The m;Ajority of claims against the US Government
          (ARMY) resulted primarily from damage to rented/leased vehicles
          and property. Some of the equipment could not be accounted for
          at (or after) the expiration date of the contract. This created
          an obligation for the Government to pay for the equipment.

          c. RECONKENDATION: The Army representatives) should notify the
          lessor immediately of property that can not be accounted for.
          Additionally, contracts should have provisions for normal
          wear/tear and stoppage of payments for dainaged/stolen equipment
          starting from the time vehicle is no longer available for use
          (DTG of police reports). Host Nation personnel or unit linguist
          participation in claims is critical. They can often negotiate
          reduced claim amounts(S-10% less) with business owners.
