         a. ISSUE: Civilian contractors and.businessmen did not
         understand the bid submission, cont@iact award and negotiation
         process used by the U.S. Government. Many thought that their bid
         submission (formal proposal) was in itself a final contract.

         b. DISCUSSION: The VII Corps requested w--itten proposals for
         bids on goods and service from individual businessmen in Saudi
         Arabia. Some of the businessmen (5-10 total), not familiar with
         the submission of formal bids prior to final contract approval,
         assumed that their bid proposals were final contracts. In a few
         instances, the Corps (ARMY) started using facilities prior to the
         owner receiving the final contract. There were some bad feelings
         generated when the contract figure was different from the
         proposed figure and the facilities were already in use and/or the
         goods already consumed.

         c. RECOFZEMATION: Foreign businessmen need to understand the
         difference between a formal proposal and approved contract at the
         beginning. The best way to accomplish this is to have a Host
         Nation representative/unit linguist present from the initial
         contact with the businessmen.
