AGENTS (RCA) WILL BE RELEASED TO US COALITION ALLIES IN THE PERSIAN
GULF REGION BY THE JOINT STAFF ON 24 JANUARY 1991. INFORMATION WILL
BE RELEASED TO THE FOLLOWING ALLIES: UNITED KINGDOM, FRANCE, ITALY,
SAUDI ARABIA, EGYPT, SYRIA, KUWAIT, OMAN, UNITED ARAB EMIRATES, QATAR,
AND BAHRAIN. NEITHER USCINCENT CONCEPT OF OPERATIONS NOR OTHER
OPERATIONAL MATTERS WILL BE DISCUSSED.

SUBJECT AUTHORITY TO USE RIOT CONTROL AGENTS
ACTION SUMMARY
1. Purpose. This action forwards a proposed Chairman's Memorandum
(Tab A) to the secretary of Defense requesting authority to use riot
control agents (RCA) in USCINCCENT AOR Also forwarded is approval
message to SCINCCENT (Tab B).
2. Discussion -
a. US policy on the use of riot cont~ol agents is derived from
Executive Order (E0) 11850.* E0 11850 renounces the fir~t use of RCAs
in war except in defensive military modes to save lives.
b Presidential approval is required for use of RCA during war
per JSCP, Annex F** and EO 11850.
c. USCINCCENT has requested authority to use riot control
- agents during hostilities in defensive modes to save lives, as an
alternative to deadly force. These defensive modes are:
(1) Riot control situations in areas under direct and
-~ distinct US military control, including the control of riotinq
-- prisoners of war.
(2) Situations in which civilians-are used to mask or screen
attacks and civilian casualties can be reduced or avoided.
(3) ~US Rescue missions in remote or isolated areas such as
recovering downed aircrews and passengers and rescuing prisoners
- of war.
(4) Rear echelon areas outside the zone of immediate cambat
_ to protect convoys from civil disturbances, terrorists, and

installations for protection and security purposes, riot
control, installation security, and evacuation of US
noncombatants and foreign nationals.
3. Recommend the Chairman, JCS:
a. Approve and forward the attached memorandum (TAB A)
requesting that SECDEF request Presidential approval to use
RCAs in USCCINCENT AOR.
b. Upon Presidential approval, approve enclosed message
(Tab B) for release to USCINCCENT.

1. I have reviewed the attached request from USCINCCENT.
I concur with the use of riot control agents (RCAs) should
hostilities occur with Iraqi forces. The RCAs will be used in strictly defensive modes to save lives as outlined in Executive Order 11850.
2. Request the attached letter be forwarded for
Presidential approval. Upon his approval, I will send a
notification message to USCINCCENT.

SUBJECT: Authority To Use Riot Control Agents
USCINCCENT has requested authority to use riot
control agents (RCAs) should hostilities occur with Iraqi
forces. The Chairman, Joint Chiefs of Staff, and I recommend
approval. The RCAs will be used in strictly defense modes to
save lives as outlined in Executive Order 11850.
I recommend that you approve and sign the enclosed
memorandum authorizing USCINCCENT authority to use riot control agents .
