MEMORANDUM FOR CHIEF OF STAFF, ARMY
SUBJECT: Biological Defense Vaccine Stocks INFORMATION
MEMORANDUM (U)
1. @ The contingency stocks in Southwest Asia (SWA) of
biological defense vaccines against anthrax and botulism and
botulinum antitoxin may have been lost due to equipment (generator,
refrigeration) failure. A medical logistics team departed 1 May to
recover all biological defense products and the associated
storage/chain of custody records and will return them to CONUS.
The status of some of these products will remain in question until
these records are reviewed and appropriate tests are conducted.
The Army will follow Food and Drug Administration (FDA) regulations
to determine the proper disposition of products in question. This
investigation will take several months to determine the efficacy
and safety of the vaccines for human use.
2. @ The depletion of the vaccine stocks in CONUS coupled with
the potential loss in SWA results in an urgent need to address
methods of reestablishing the vaccine stocks. The

recipients can be matched with product lots. Legal opinions imply
that, unless there is a stated urgent and compelling need to
replenish the stocks, the Army should refrain from providing
indemnification.
4. @ The Joint Staff is currently staffing an action for the
Secretary of Defense which cites an urgent and compelling need. In
parallel, the ODCSOPS is drafting a memo for the Army Acquisition
office stressing the operational need for a fully configured
